Tuo Africa Terms and Conditions

Welcome to Tuo Africa, Registration Number: 2021/151458/07. These Terms and Conditions (“Terms”) govern your use of our website and services. By accessing or using our website and services, you agree to comply with and be bound by these Terms. Please read them carefully. 

  1. Introduction

Tuo Africa provides travel services, including safari tours, adventure experiences, and related travel arrangements. By using our services, you agree to these Terms, our Privacy Policy, and any other policies we may implement from time to time. 

  1. Booking and Payment

2.1 Booking Process: To book a trip with Tuo Africa, you must provide accurate and complete information. All bookings are subject to availability and confirmation. 

2.2 Payment Terms: A deposit of 50% or a full payment is required at the time of booking to secure your reservation. The remaining balance must be paid 30 to 60 days before the start of your trip, depending on the property booked.  If a booking is made less than 60 days prior to travel, the full 100% cost of the booking (“total booking price”) must be paid upfront. Failure to make the required deposit(s) means that we will be unable to confirm the booking for you 

2.3 Pricing: All prices are quoted in Rands and are subject to change without notice. All prices quoted on the Tuo Africa website are ‘cash discounted’. Payment is required by EFT, (bank transfer). In the case of an overseas bank transfer an administration fee of R 400.00 per payment will be charged. If you fail to make any payments on or before the due date, your booking will be canceled and you will forfeit the relevant deposit(s) paid. 

All quotations and confirmations generated by us are based upon external supplier costs such as accommodation, park fees, and gate fees which are outside of our control. These supplier costs are therefore subject to change until final payment has been received or, these costs will be for your account. 

 

  1. Cancellations and Refunds

3.1 Cancellation by You:  

All booking cancellations must be made by you in writing. If you cancel by email, you must obtain and retain an email proof of receipt and written acknowledgment from us. If you cancel a booking for any reason, whether in part or in full: 

  1. More than 60 days prior to departure: You will forfeit the non-refundable deposits already paid. 
  1. 60 days or less prior to departure: You will be liable for 100% of the total booking price. 

In some cases, if we can obtain a waiver of cancellation fees or a refund from one or more suppliers, we will refund these amounts, less our service fees, to you. We will make every effort to confirm the required services after receiving your deposit. If we are unable to confirm the services, you will be offered alternative travel services. If the alternatives are not acceptable, we will provide a full refund for those services. While we strive to ensure the delivery of the services in your confirmed itinerary, we reserve the right to cancel services due to circumstances beyond our control. In such cases, we will provide a full refund for the cancelled service(s) only. No refunds will be given for partly used vouchers or no-shows. 

3.2 Cancellation by Us: Tuo Africa reserves the right to cancel your booking due to unforeseen circumstances or events beyond our control. In such cases, we will offer an alternative trip or a full refund. 

3.3 Refund Policy: Refunds will be processed within 2 to 30 days of receiving your cancellation notice. Any non-refundable deposits or fees will be deducted from the total refund amount. 

 

  1. Changes to Bookings

4.1 Changes by You:  

Please note that you will be responsible for any additional charges arising from booking changes, whether voluntary or involuntary. This includes: 

 

All costs and fees resulting from changes requested by you. 

All costs and fees resulting from necessary changes caused by airline schedule changes, airport strikes, or any other ‘acts of God’ (e.g., war, riots, strikes, civil disruption, terrorist activity, natural or nuclear disaster, weather, epidemics, fire, or any other circumstances beyond the control of the parties). 

We will make every effort to adhere to the confirmed itinerary. For significant involuntary changes, such as those affecting accommodation or transportation, we undertake to: 

 

Provide a reasonable alternative at minimal or no extra cost, subject to the terms and conditions of any third-party supplier. 

Where you decline a reasonable alternative or where none is available: 

Provide a refund for the affected service(s), subject to the terms and conditions of the relevant supplier; and/or 

Assist you in identifying alternative services, the costs of which will be your responsibility. 

We will use our best efforts to accommodate any voluntary changes requested by you. However, in addition to the additional costs arising from these changes, including those charged by the relevant supplier(s), we reserve the right to charge cancellation fees (as referred to below) and additional administration fees of R300 per person per amended booking. 

4.2 Changes by Us: Tuo Africa reserves the right to make changes to your itinerary, including accommodation and activities, due to unforeseen circumstances. We will notify you of any significant changes as soon as possible. 

  1. Travel Insurance

Travel insurance is strongly recommended for all participants. It is your responsibility to ensure that you have adequate coverage for medical expenses, trip cancellation, and other potential risks. 

  1. Health and Safety

6.1 Health Requirements: You must ensure that you are in good health and physically capable of participating in the activities included in your trip. Please inform us of any medical conditions or special requirements at the time of booking. 

6.2 Safety Measures: Tuo Africa prioritizes your safety. However, you acknowledge that travel involves inherent risks, and you agree to assume all risks associated with your trip. Follow the instructions of our guides and adhere to safety protocols at all times. 

  1. Conduct and Behavior

7.1 Code of Conduct: You are expected to behave respectfully and responsibly during your trip. Any behavior that is deemed disruptive, dangerous, or disrespectful may result in your removal from the tour without a refund. 

7.2 Compliance with Laws: You must comply with all local laws and regulations during your trip. Tuo Africa is not responsible for any legal issues arising from your failure to comply with local laws. 

  1. Intellectual Property

All content on the Tuo Africa website, including text, images, logos, and trademarks, is the property of Tuo Africa or its licensors. You may not use, reproduce, or distribute any content without our prior written consent. 

  1. Limitation of Liability

To the fullest extent permitted by law, Tuo Africa shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability to you shall not exceed the total amount paid for your booking. 

  1. Governing Law

These Terms are governed by and construed in accordance with the laws of South Africa. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts in South Africa. 

  1. Changes to These Terms

Tuo Africa reserves the right to update or modify these Terms at any time. Any changes will be posted on our website, and your continued use of our services constitutes acceptance of the revised Terms.
